Sheriff Real Estate Sale Information

All sales are held pursuant to O.R.C. §2329.09 – 2329.17 & 2329.53.

Sheriff Sales are conducted at 10:00 a.m. on Tuesdays (or at such other time and day as directed by the Sheriff) in the main lobby of the Ashland County Sheriff’s Office at 1205 East Main Street, Ashland, Ohio.

Sheriff Sales (Bank Foreclosures)

This is a sale for non-payment of mortgage.  Properties are appraised and advertised before each sale date.  Each property the Sheriff is ordered to sell will have two sale dates advertised.  If the property is not sold at the first advertised date, it will be put up for sale on the second advertised date.  If it is sold on the first date, there will not be a second sale for that property.

All sales are published in the Ashland Times Gazette, Ashland, Ohio, in the classified section in Thursday’s edition.  Sales are published for 3 consecutive weeks prior to sale.

Sheriff sales are held as an open auction in the lobby of the Sheriff’s Office.  The minimum starting bid on the first sale date is two-thirds the appraised value.  If the property is not sold or no minimum bid is received at the first sale, a second sale will be held two weeks later with no minimum bid required.  Purchasers are responsible for any fees or costs associated with the property not covered by the sale price.  The buyer is responsible to pay a deposit as explained in the O.R.C §2913.211 at the time of the sale, regardless of the sale price.  The Sheriff’s Office will take personal checks or cashier’s checks for the deposit amount.  All checks should be made payable to the Ashland County Sheriff’s Office.  No cash will be accepted.

The Sheriff’s Office does not have access to these properties for viewing. You are buying the property as it is or “buyer beware” and properties are not open for inspection at any time prior to sale.  All properties are appraised from the outside only.  All taxes and all known liens are paid out of the proceeds of the sale.  Public notice is hereby given that all such real property to be sold at public auction may be subject to a federal tax lien that may not be extinguished by the sale.  Purchasers of any such real property are urged to search the federal tax lien index that is kept by the County Recorder to determine if notice of the federal tax lien has been filed with respect to any such real property.

The Buyer is given a sheriff’s deed after the court has confirmed the sale.  This is a court action and may take several weeks and sometimes several months to complete.

Terms of Sale

• First Sale Date: Bidding will begin at 2/3 of the appraised value

• Second Sale Date: No minimum bid.

• Requirements for Third Party Purchasers:

  • Driver’s License or State ID

  • Deposit: If the appraised value of the property is:

    • Less than or equal to $10,000.00 – Deposit is $2,000.00

    • Greater than $10,000.00 and less than or equal to $200,000.00 – Deposit of $5,000.00

    • Greater than $200,000.00 – Deposit of $10,000.00

  • Due at the time of the sale by personal or certified check – No Cash

• Deposits are not refunded

• Balance will be due 30 days following the confirmation of the sale.

• Buyer is given a sheriff’s deed after the court has confirmed the sale. This is a court action and may take several weeks and sometimes several months to complete.
